OFFICIAL BROWN ACT COMPLAINT FILED W/LOS ANGELES DISTRICT ATTORNEY OFFICE, re: City Hall ID Check To Attend Council/Committee Meetings:
This complaint was filed, today (02/27/12), with the Los Angeles District Attorney Office, online:
Dear District Attorney's Office,
HERE IS YouTube VIDEO OF ME APPROACHING VISITOR DESK AT LOBBY OF L.A. CITY HALL on 02/17/12:
The point IS...you are not required to show ID to enter the city hall for the council meeting...and you are NOT required to be an attorney to state the name of the law.
On February 17, 2012, entered L.A. City Hall and the police officer, behind the visitor desk, asked for my ID.
I said, "No, not today, thank you."
The officer asked me where I was going. I said the council meeting.
She insisted for the ID again. I again replied that I did not want to show ID to attend the meeting.
She called another supervising officer to the desk, who again, asked me where I was going, then asked for ID. [I got nervous when the one cop called over the second cop. Was I in trouble? Imagine how anyone else would fee?]
I again, had to explain I did not want to show ID. Then he required me to utter the words, "Brown Act," before the other officer would hand me the pass.
The point is that no ID is required to attend the council meeting. Not that the person, showing up to give public comment or observe the meeting, has to be a legal expert and know the names of the laws. The laws are merely to be followed.
This was more than anyone should be expected to reasonably endure to be admitted to the council meeting. The request alone has a chilling effect.
February 21, 2012, I once again entered Los Angeles City Hall, went through the metal check, the walked to the lobby desk for a "visitor" pass, to attend the L.A. City council meeting.
The officer (a different officer) said, "Let me guess, no ID." I said, "right." She explained, "That's fine." (As in cutting a break/no biggie/slack was being given). Then added, but, the Brown Act applies to the council meeting. This is the lobby. We don't share information. And you are not required to show ID to enter the meeting.
When I said, "That means you have to show ID to enter the meeting," there was some more back and forth. HERE IS THE ENTIRE AUDIO OF THE CONVERSATION:

City Hall strategy appears to be, "We DON'T require ID to attend the meeting. But, due to security issues, everyone must show ID (and the police write the name and address down on paper, as in a record book). And then, they may attend the meeting without showing ID. And since the City Hall lobby doesn't share the information with Council, it's allowed.
However, not requiring ID to attend the meeting, means you don't need to have an ID. BUT, if you need an ID to enter City Hall, that means you cannot enter the council meeting.
Additionally, the process has a chilling effect on anyone who would walk up to City Hall, see a line of people showing ID to the police, or if no line, getting to the lobby desk and having a police officer ask you for ID.
The City will argue that it is required for security, but if someone breaks the law in city hall, then a cop will detain the person -- AND THAT IS THE POINT IN WHICH YOU ASK FOR ID!
The officer told me, it was annouced in "roll call," that they WERE going to start REQUIRING ID, with no "Brown Act" proclamations in the lobby, because Brown Act does not apply to the lobby.
This already has a chilling effect on Zuma Dogg, cause I don't wanna wake up early, leave my beach area, to head all the way to Skid Row adjacent, through gridlock traffic, only to find out, TODAY, is the day the city starts enforcing that ID is required. CAUSE I AIN'T GIVING CITY HALL THE INFO (LIKE MY ADDRESS) -- TO ATTEND THE COUNCIL MEETING!
BOTTOM LINE: There is no way to attend the L.A. City Council meeting without showing identification, FIRST.
City Hall has a red VISITOR pass (different than the blue VISITOR pass), to distinguish between those going to the council meeting, who did not show ID (and are restricted to the council or committee meeting/cannot go to other floors, or departments). So, WHY do you need to show ID at the door?
ADDITIONALLY, until this month, they have been asking for people's name and address on the public comment cards, without disclosing the information is NOT required -- and that they are public documents, posted online.
How long is statue of limitations for this violation? Posting addresses online, without saying, "not required," is just about the most outrageous violation I can think of. A lot of BAD people, out there, who can access the info!

Zuma Dogg EXPOSES NEW Constitutional Flaws on Trutanich's Venice Beach 42.15 (Council Agenda Item: 12/13/11) - REAL LEGAL TALK
Zuma Dogg Presents MORE HARDCORE Constitutional FLAWS in L.A. City Attorney Carmen Trutanich's Venice Beach Ordinance 42.15.
QUICK SUMMARY: Friday, 12/9/11, Bill "Rosendope" Rosehdahl's Office sent out notice and the agenda item for 42.15, to be in council chambers (for a vote), this Tues, 12/13/11.
THEN, Rosendope's office believes they may have sent out the wrong link (not updated) and on SATURDAY, RE-SEND a NEW LINK to everyone...AGAIN...city does not do business on Saturday, and this is a BROWN ACT ITEM.
The City did not notify Zuma Dogg or his attorney. Zuma Dogg won a lawsuit in Federal Court, last year (still unsettled with L.A. City), and this ordinance affects ZD...and how funny they don't tell me or my attorney.
BUT OTHER PEOPLE DID -- AND ZUMA DOGG GOT EMAILS ABOUT IT ON SATURDAY, WHICH MADE HIM CRANKY. SO I TYPED THIS GENERAL REPLY:

This is all merely my opinion, based on five years of deep, day to day involvement (my entire life) regarding Venice Beach boardwalk Ordinance 42.15 (Venice Beach boardwalk regulations.)
After a round of local neighborhood council, commission and committee meetings; and after being continued from last month (Nov '11), the item is, once again, in Los Angeles City Council chambers (up for a vote), this Tuesday, December 13, 2011.
As many readers know, my rights were violated on the boardwalk, under previous drafts of this ordinance, and I had to sue in Federal Court to make them stop. (A Federal judge ruled in favor of Zuma Dogg, et al, against the City of L.A. and placed an injunction on the various illegal, 1st Amendment/Constitutional violations, this very country was founded upon. And it WAS the FIRST amendment.)
And ZD was not the only one impinged, harassed and illegally violated. Some people had babies and kids and lost them to foster care, when parents lost their income, when the city prevented them from LEGAL ACTIVITY in the U.S.A.
So as word is hitting the community that the Ordinance is in council chambers and up for a vote, Tuesday; some people are contacting me to make sure I am aware; and some are contacting me to ask me what I think will happen.
Here is an email I sent to one person. It makes a nice "Official Reply From Zuma Dogg Regarding 42.15, Up For An L.A. City Council Vote on Tuesday, 12/13/11."
Dear (Constituent),
In reply to the question in your email:
It was on agenda, last month (Nov) as you may have known. It was continued until Tues 12/13. So that WOULD be the 1st reading. But, ZD hears A LOT from inside sources.
1) Council HATES Bill. He interferes on their things like AEG Stadium deal/etc. They won't mind tripping him up, just to give him a black eye/payback.
2) AND, it's a BIG mess; Arts/Parks/Rec Committee Member & NEW L.A. City Council President, Herb Wesson not happy it's been 5 years, and doesn't want to be back here, next year, on this issue. City Attorney admitted in committee to Herb, "Yes, it's flawed/not perfect, but we have to do something." (Herb don't care that Bill is in a political hurry) AND, the other councilmembers are not going to put themselves at risk, by voting yes, on something they know stinks (flawed/problems/judge won't like seeing them in court, with Zuma Dogg, again.) Council HATES City Attorney Carmen Trutanich, more than Bill. And they know Trutanich BLOWS things, out of vindictiveness...so they ain't gonna do Rosendhal or Trutanbitch any favors/put themselves at risk, JUST CAUSE WEAKEST-CM ROSENDAHL & TRUTANICH WANT WRAP IT UP, THE WAY OBAMA WANTS TO WRAP UP HIS, "JOBS BILL" before X-mas.
3) BIG!: You probably haven't heard (cause it's a secret), the city made a decision and now considers the entire Venice boardwalk a "park," in an attempt to be able to do more regarding homeless removal/enforcement. They have decided they CAN go up and take your stuff if you are not there, store it for 30 days, etc. A LOT OF ISSUES THAT LAPD IS NOT READY FOR, THAT HAVE NOT EVEN BEEN FULLY DISCUSSED (regarding enforcement.)
Someone ZD trusts LAUGHED and said it would be PREPOSTEROUS to pass it on Tues. They don't even consider it an reasonable option.
SO WE'LL SEE HOW SHADY COUNCIL IS. It hasn't been officially continued...and you may think I am biased (hoping the city keeps making FOOLS of themselves, but I WANT the new laws passed already, for my own personal & performing interests as a long time Venice performer and Venice local)...but after attending/watching meetings for five years...EVEN ZUMA DOGG (WHO HAS SEEN IT ALL) WOULD BE SHOCKED IF THEY DID NOT CONTINUE IT.
ESPECIALLY AND MOST based on the last part about considering the boardwalk a park, and all these LAPD issues.

BUT NOW, I can see why you didn't send me the LATEST UPDATE and I had to be like Kevin Cronin of REO Speedwagon and, "heard it from a friend, who heard it from a friend..."
Your LATEST CARMEN THE CLOWN PIECE OF SOON TO BE INJUNCTED, PIECE OF LEGISLATIVE COMEDY, reveals several additional constitutional flaws, which I will summarize, in part, briefly (as in LEGAL BRIEF YOUR ASS) below:
To paraphrase my attorney, "vague, ambiguous, irrational and unconstitutional distinction between 'creating visual art in its entirety' (which is allowed) -- and the 'completion' or 'partial' creation of visual art (which is not allowed). Visual art that is completed or partially created on the Boardwalk deserves as much First Amendment protection as visual art that is created entirely on the Boardwalk.
To put in it ZumaLease: This says you can't "decorate" or "customize" things. For example, you can't take a belt and "bedazzle" (customize) it. PRETTY RESTRICTIVE. And then the ambiguous task of LAPD enforcement/trying to sort it out. "Excuse me...I see you painted that statue of L.A. City Hall red, white and blue, like a flag. Did you MAKE that statue of city hall, yourself, or did you get it somewhere else, and then paint it?" Or, "Good morning. I see you have jewels on that paperweight. Did you MAKE that paperweight? Says, "made in China," on the bottom of the paperweight." This is what "partial creation" means. PRETTY RESTRICTIVE!
Likewise, visual art that is "mass produced" or "produced in limited variation" is not entitled to any less First Amendment protection than visual art that is created entirely on the Boardwalk. [Guess I have to make each Zuma Dogg bobble head or Carmen The Clown doll, by hand. Can't mass produce them -- and can't use other things to make them out of, as the canvas/medium. If I wanted to take a Kojak doll and stick an Afro on it, as a parody, ILLEGAL UNDER TRUTANICH! I HAVE TO MAKE THE KOJAK DOLL, TOO!]
In other words, you have to make EACH AND EVERY ITEM, by hand/can't be mass produced? So if I wanna sell Zuma Dogg "Bobble-heads" (or a "Trutanich The Clown" doll), you have to make each one by hand, and can't have them on cafepress. And, if I want to hand out, "DO NOT VOTE FOR CARMEN TRUTANICH," posters, I can't have them printed at Kinkos? The paper is just the medium, dude. It's not about the process of getting the ink on the canvas, BULLY!
Furthermore, the term "Handcrafts" is vague, ambiguous, irrational and unconstitutional. Why is the artistic expression involved in "weaving, carving, stitching, sewing and beading" (which is not allowed) entitled to less First Amendment protection than painting, sculpture and other forms of artistic expression (which are allowed), dumb asses? (THINK ABOUT OUT THAT??? "Clay is O.K.! Wood is no good?" INSANITY!!! Reminds me of some overseas country, we fight wars against, over these types of constitution, artistic expression issues. Maybe Trutanich should move to SOME OTHER country.)
Moreover, your latest loser version of 42.15 bans ALL "Handcrafts," yet it only finds that "most" Handcrafts are not allowed, over "nominal utility" issue, that I won't try to explain here. QUICK SUMMARY: Friday, 12/9/11, Bill "Rosendope" Rosehdahl's Office sent out notice and the agenda item for 42.15, to be in council chambers (for a vote), this Tues, 12/13/11.
THEN, Rosendope's office believes they may have sent out the wrong link (not updated) and on SATURDAY, RE-SEND a NEW LINK to everyone...AGAIN...city does not do business on Saturday, and this is a BROWN ACT ITEM.
The City did not notify Zuma Dogg or his attorney. Zuma Dogg won a lawsuit in Federal Court, last year (still unsettled with L.A. City), and this ordinance affects ZD...and how funny they don't tell me or my attorney.

This is all merely my opinion, based on five years of deep, day to day involvement (my entire life) regarding Venice Beach boardwalk Ordinance 42.15 (Venice Beach boardwalk regulations.)
After a round of local neighborhood council, commission and committee meetings; and after being continued from last month (Nov '11), the item is, once again, in Los Angeles City Council chambers (up for a vote), this Tuesday, December 13, 2011.
As many readers know, my rights were violated on the boardwalk, under previous drafts of this ordinance, and I had to sue in Federal Court to make them stop. (A Federal judge ruled in favor of Zuma Dogg, et al, against the City of L.A. and placed an injunction on the various illegal, 1st Amendment/Constitutional violations, this very country was founded upon. And it WAS the FIRST amendment.)
And ZD was not the only one impinged, harassed and illegally violated. Some people had babies and kids and lost them to foster care, when parents lost their income, when the city prevented them from LEGAL ACTIVITY in the U.S.A.
So as word is hitting the community that the Ordinance is in council chambers and up for a vote, Tuesday; some people are contacting me to make sure I am aware; and some are contacting me to ask me what I think will happen.
Here is an email I sent to one person. It makes a nice "Official Reply From Zuma Dogg Regarding 42.15, Up For An L.A. City Council Vote on Tuesday, 12/13/11."

It was on agenda, last month (Nov) as you may have known. It was continued until Tues 12/13. So that WOULD be the 1st reading. But, ZD hears A LOT from inside sources.
1) Council HATES Bill. He interferes on their things like AEG Stadium deal/etc. They won't mind tripping him up, just to give him a black eye/payback.
2) AND, it's a BIG mess; Arts/Parks/Rec Committee Member & NEW L.A. City Council President, Herb Wesson not happy it's been 5 years, and doesn't want to be back here, next year, on this issue. City Attorney admitted in committee to Herb, "Yes, it's flawed/not perfect, but we have to do something." (Herb don't care that Bill is in a political hurry) AND, the other councilmembers are not going to put themselves at risk, by voting yes, on something they know stinks (flawed/problems/judge won't like seeing them in court, with Zuma Dogg, again.) Council HATES City Attorney Carmen Trutanich, more than Bill. And they know Trutanich BLOWS things, out of vindictiveness...so they ain't gonna do Rosendhal or Trutanbitch any favors/put themselves at risk, JUST CAUSE WEAKEST-CM ROSENDAHL & TRUTANICH WANT WRAP IT UP, THE WAY OBAMA WANTS TO WRAP UP HIS, "JOBS BILL" before X-mas.
3) BIG!: You probably haven't heard (cause it's a secret), the city made a decision and now considers the entire Venice boardwalk a "park," in an attempt to be able to do more regarding homeless removal/enforcement. They have decided they CAN go up and take your stuff if you are not there, store it for 30 days, etc. A LOT OF ISSUES THAT LAPD IS NOT READY FOR, THAT HAVE NOT EVEN BEEN FULLY DISCUSSED (regarding enforcement.)
Someone ZD trusts LAUGHED and said it would be PREPOSTEROUS to pass it on Tues. They don't even consider it an reasonable option.
SO WE'LL SEE HOW SHADY COUNCIL IS. It hasn't been officially continued...and you may think I am biased (hoping the city keeps making FOOLS of themselves, but I WANT the new laws passed already, for my own personal & performing interests as a long time Venice performer and Venice local)...but after attending/watching meetings for five years...EVEN ZUMA DOGG (WHO HAS SEEN IT ALL) WOULD BE SHOCKED IF THEY DID NOT CONTINUE IT.
ESPECIALLY AND MOST based on the last part about considering the boardwalk a park, and all these LAPD issues.

Did you MAKE that statue of city hall, yourself, or did you get it somewhere else, and then paint it?" Or, "Good morning. I see you have jewels on that paperweight. Did you MAKE that paperweight? Says, "made in China," on the bottom of the paperweight." This is what "partial creation" means. PRETTY RESTRICTIVE!
Likewise, visual art that is "mass produced" or "produced in limited variation" is not entitled to any less First Amendment protection than visual art that is created entirely on the Boardwalk. RED HOT CHILI PEPPERS SECRET SHOW: At The Troubador, TONIGHT (7/31/11)? Tour Bus Chatter Says, "HEAD THERE, NOW!"

Yesterday (7/30/11), Zuma Dogg, was allowed EXCLUSIVE fan access to the RED HOT CHILI PEPPERS tour bus area, to film them coming out of their bus -- as they walked down Venice's Speedway Blvd, back alley, on the way to the roof top, of their now famous (AND infamous) "music video" shoot and MASSIVE MUNICIPAL violation.
As mentioned, they had a permit for ONE of the words in, "music video," -- THE MUSIC PART...as in four amps a drum set up and rambunctious melody-blasting singer. But, NOT for the crane that was swingin' over the heads of the July-Saturday boardwalk crowd, belooooooooooooow!
AND, the fact that the Chili Peps, not only didn't file a permit to shoot a music VIDEO...only to perform music (at a level within municipal code...which I ASSURE YOU is LESS than what yesterday's entire ZIP CODE broadcast was within limits of) -- meant the City of Los Angeles (LAPD/LAFD) had NO IDEA what was about to hit the area. (A CROWD OF THE MASSES...rollin' in like a Pink Floyd stadium show.) SO EVERY COP, FIRE FIGHTER, EMS & RIOT SQUAD (yes, they were there) HAD TO BE PULLED FROM ALL ACROSS THE CITY TO MANAGE THE FLASH MOB CROWD, which it was, cause there was no previous notice/warning...till the crane it was a swingin'. (DEFINITELY NOT ALLOWD TO DRAG A MEGA-CRANE ACROSS THE BOARDWALK AND OVER THE HEADS OF PEOPLE WITHOUT A LITTLE MITIGATION!)
BUT ANYWAY...now that EVERY RED HOT CHILI PEPPER FAN ACROSS THE PLANET HATES ME...(Sorry, I'm an extremely bipolar, city activist, who has been cracked down on the Venice Beach boardwalk from singing too loud WITHOUT an amplifier. And my band mate (Matt Dowd) is facing CRIMINAL PROSECUTION CHARGES for having his amp and guitar in some (un-marked) part of the sidewalk, they allegedly claim, BUT EVEN WORSE, ENFORCE AND PROSECUTE, CRIMINAL CHARGES, OVER...so we're a little bit touchy!
BUT HERE'S WHAT YOU TUNED IN FOR: When I was standing by the tour bus, yesterday (Saturday, 7/30/11), I heard someone else standing next to me (and I was the only person NOT affiliated with the band/crew, so they must have been in the know) -- said, "So it's at the Troubadour, tomorrow?"
So that would be, TODAY...as in...IF YOU'RE WILLING TO RISK IT, I'D GET OVER THERE, NOW! (Unless he was talking about his kid's garage band?)

No wonder I think your clients (writers, actors, producers) are losers.STORY: Local public access TV personality, Zuma Dogg was told by City Hall he couldn't set up his amp or sell Zuma Dogg shirts, CDs & DVDs at Venice Beach boardwalk, anymore. ZD protested this 1st Amendment violation of the U.S. Constitution inside the chambers of L.A. City Hall, as televised LIVE throughout the city, and created more political backlash against them than any single voice in history -- and woke up the whole city to the fraud, waste and abuse that pushed the city to the edge of bankruptcy. On October 2010, a Federal Judge agreed with Zuma Dogg, who sued the city over this matter, and issued an injunction against the city as they prepare to pay Zuma Dogg for damages.
It's either an Academy Award worthy movie in the right hands or the biggest cable network talk show in television history. (Not second biggest, and biggest by a lot.)
